The Honorable Tom McDonald is a retired judge and mediator who practiced for the Jefferson District Court, Jefferson Circuit Court, and the Circuit Court of Kentucky for just over 25 years. His extensive judicial experience made way for the formation of his own mediation and arbitration practice in 2004 after retiring from the bench, and has since earned him more than 3,100 completed mediations with a 94 percent success rate. Mr. McDonald has extensive experience in complex civil matters, including personal injury, medical malpractice, product liability, real estate and construction disputes, and contract litigation, and has substantial case experience in the following areas: commercial/business, contract disputes, discrimination, employment, legal malpractice, medical malpractice, personal injury, premises liability, professional liability, real estate, sexual harassment, torts and wrongful death.
Mr. McDonald taught at the University of Louisville as a law instructor between 1984 and 2004. He also spent time as a faculty member of the civil mediation program at National Judicial College and has lectured at Harvard University Law School. Named one of Louisville's Best Attorney's in Mediation by Louisville Magazine in 2013, 2014 and 2016, Mr. McDonald was formerly known for having testified before committees of both the U.S. Senate and the House of Representatives as an expert in the area of child abuse prevention and treatment and for being instrumental in the complete revision of the laws that protected abused and neglected children in the state of Kentucky. Prior to becoming a judge, Mr. McDonald upheld his own private practice for three years and was an assistant county attorney for two years in the early 1980s.
A BA cum laude graduate of the University of Louisville in 1977, Mr. McDonald then spent a year studying foreign law at the University of London in England before earning a JD at the Brandeis School of Law of University of Louisville in 1980. Accepted to practice by the Supreme Court of the United States, the Western District of the U.S. District Court of Kentucky, and every court in Kentucky, Mr. McDonald also completed 40 hours of study at National Judicial College via a civil mediation course in 2002, and another 40 hours of study through the Federal Mediation and Conciliation Service via an arbitration course in 2004.
Mr. McDonald was selected as a member of the National Academy of Distinguished Neutrals in 2016, and has been named in Who's Who in American Law, as well as Who's Who of Emerging Leaders in America. He is married married to Judge Dee McDonald, an active sitting judge, and has two children.
