Mr. Summit is a retired attorney who formerly served as partner at Phillips, Nizer, Benjamin, Krim & Ballon (now Phillips Nizer LLP) in New York City. From 1993, he was a senior litigation partner of Phillips Nizer LLP. As a lead counsel in a wide variety of business-related litigations and arbitrations, his cases often involved computer software, will contests, property rights, marine insurance coverage and federal securities law claims. His extensive courtroom experience enabled him to achieve many productive settlements and lead a host of corporate internal investigations. Mr. Summit previously served as partner at Summit, Rovins & Feldesman between 1976 and 1993 and Miller & Summit between 1967 and 1976. He was a law secretary to Associate Justice Charles D. Breitel of the New York Supreme Court, Appellate Division. He also spent six years as an associate at Mudge, Stern, Baldwin & Todd between 1960 and 1966.
A member of multiple professional organizations, Mr. Summit remains active with the New York State Bar Association and was a member of the judicial selection and tenure committee member of the Association of the Bar of the City of New York. He is also a former trustee of the Federal Bar Foundation and former president and trustee of the Ohio State University Law Alumni Association. He notably served as the executive secretary of the New York City mayor's committee on the judiciary and served as counsel, then senior counsel to the New York State Commission on Judicial Nomination from its inception in 1978 until 2014. Mr. Summit served as a mediator for the Commercial Division of the New York County Supreme Court, special master of the Appellate Division First Department and in many substantial private mediations.
Mr. Summit has written and lectured on various topics regarding litigation strategy and management. Between 1984 and 1996, he lectured annually for the Association of the Bar of the City of New York on preparation and defense of examinations before trial. He was also a senior editor of the "Federal Litigation Guide" of New York and Connecticut.
Mr. Summit was a trustee for the Boys and Girls Club of America for 11 years between 1980 and 1991 and an advisory council member for the Fashion Institute of Technology for three years between 1993 and 1996. He also was Chairman of The Alumni Advisory Council at The Ohio State University and served on the National Council of the Ohio State University Law College.
Following in the footsteps of his father who was also an attorney, Mr. Summit was a graduate of The Ohio State University, earning a BS in Business Administration in 1957 and JD summa cum laude in 1959. While pursuing his juris doctorate, he became a member of the Order of the Coif. Mr. Summit has been admitted to the New York, Ohio and D.C. Bars, the Eastern and Southern Districts of the U.S. District Court of New York, the Second and Fifth Circuits of the U.S. Court of Appeals and the Supreme Court of the United States.
Recognized as an AV-Preeminent Attorney by Martindale-Hubbell, Mr. Summit has also been named to Super Lawyers for general litigation for the metro New York edition every year since 2009. He has been showcased in several editions of Who's Who in America and Who's Who in American Law as well.
