Ivera Medical Corporation Files Suit Against Excelsior Medical Corporation for Patent Infringement

    SAN DIEGO, CA, May 17, 2011 /24-7PressRelease/ -- Ivera Medical Corporation, headquartered in San Diego, CA, filed suit against Excelsior Medical Corporation of Neptune, NJ, for patent infringement arising under the patent laws of the United States of America, 35 U.S.C. Section 1, et seq. The suit was filed in the U.S. District Court, Eastern District of Texas, Tyler, TX (Civil Case No. 11-cv-0426-W-WMC.)

Ivera manufactures, markets, and sells the Curos Port Protector, a device that disinfects and protects the entry port on certain types of valves used with intravenous lines to help reduce bloodstream infections in hospital patients. On August 24, 2010, United States Patent No. 7,780,794 B2 (the '794 patent), on an invention entitled "Medical Implement Cleaning Device," was issued by the United States Patent and Trademark Office. The '794 patent has been in force and effect since its issuance.

The Ivera suit claims Excelsior sells throughout the United States a product line it refers to as the SwabCap which infringes one or more claims of the patent. As a result, Ivera has been damaged due to acts of infringement by Excelsior and will continue to suffer irreparable injury unless Excelsior's activities are enjoined.

Ivera has asked the courts to compel Excelsior to permanently enjoin Excelsior from further infringing the '794 patent, require Excelsior to withdraw from distribution all infringing products and to award damages adequate to compensate Ivera for the damages it has suffered as a result of Excelsior's willful infringement.
