The Gilbert Law Group Wins Record Verdict in Collapsed Seatback Case

The case resulted in a Vermont jury awarding a $43.2 million verdict against vehicle seat manufacturer, Johnson Controls, Inc. on behalf of a Gilbert Law Group client.

The case involved an incident that happened in August 2007. Dzemila Heco, the Plaintiff, was in her Dodge Neon when she was rear-ended while stopped at a red light. Ms. Heco's seatback collapsed and ejected her into the rear seat area. She suffered a paralyzing neck injury that resulted in her being permanently quadriplegic. Immediately following the accident, Ms. Heco could no longer work and is now totally reliant on others for all of her care.

At trial, The Gilbert Law Group declared that the seatback was too weak to hold the seatback upright, and that a dual-sided recliner would have prevented the seatback from moving and twisting rearward. Johnson Controls' own internal documents confirmed their knowledge that the single-sided recliner failed at 8,000 and 9,000 inch-pounds of force. Two years prior to the Plaintiff's accident, Johnson Control even filed a patent about the weakness of single-sided recliners and the benefits of the dual-sided recliners.

Along with co-counsel Langdon & Emison and Van Dorn & Curtiss, The Gilbert Law Group's collapsed seatbelt case resulted in the biggest jury verdict win in Vermont-state history. The Vermont jury found in favor of the Plaintiff because it was proven that the seat should, and could, have been made safer.
